VATICAN CORRUPTION 2012 AND “HIS HOLINESS”

The recent release of the book written by journalist Gianluigi Nuzzi “Sua Santità(“His Holiness”). The secret papers of Benedict XVI. ” has provoked a bitter reaction by the Vatican. Their heated reaction confirms the validity and seriousness of what journalistic investigation brought to light. In a leak from the Vatican, the publication was described as “criminal”, an internal investigation was implemented immediately which to date has resulted in the arrest of a Vatican employee. Surprising, but true, no such action was initiated in the cases of IOR – Paul Marcinkus, crack Ambrosian, Roberto Calvi and despite the warrant of arrest issued by the then magistrate of the Court of Milan, Dr. Renato Bricchetti, against Monsignor Marcinkus, is being protected as a Vatican diplomat, nor has such rigorous acting been seen in the numerous cases of pedophilia within the Catholic church, where until recently it has been argued that there is no obligation to charge purpetrators. No such rigor has been displayed in the  long standing affair regarding the emissions by the radio antennas of Ponte Galeria, causing leukemia in children, nor in the case of Emanuela Orlandi, nor with regard to the evictions of disabled and disadvantaged people from Vatican owned real estate despite their vast assets and capital. Not to mention the fact that to date the Vatican State has still not implemented law against money laundering, evading  relevant discipline by not allowing Italian and international criminal investigations regarding activities of the the IOR (Vatican Bank). Excellent work by, Gianluigi Nuzzi well orth reading. And to think that in times of the inquisition he would have already been in the dungeons of the secular arm and next to be burnt at the stake.

Tuesday, March 13 will begin the process, before the Court of Cagliari – Carbonia (Sardinia – Italy), against the alleged hackers accused, just eighteen, that he unlawfully introduced into the NASA computer system, causing damage by malicious software, as well as to have snatched a user and password of the system. This will be the defender of confidence Lawyer Gianfranco Annino, who will claim the reasons for the young defendant, who has always maintained his objections to the stranger.

Nel diritto, nel diritto penale e nelle regole che disciplinano il processo penale non c’è spazio per l’emotività; il diritto si applica, il diritto disciplina e cataloga i fatti umani che possono essere penalmente rilevanti (quando il fatto è tipico: coincidenza tra la norma astratta e il fatto concreto) o indifferenti. A monte di qualsiasi valutazione penale, i principi della Convenzione Europea dei Diritti dell’Uomo ed il principio di non colpevolezza (dimenticato) portato dall’art. 27 della Costituzione. Quanto sta avvenendo in questi giorni in relazione al naufragio della Costa Concordia mostra il volto di un diritto deviato dall’emotività e dal volto inquisitorio; basti pensare alle dichiarazioni rese pubblicamente dagli inquirenti, dai documenti diffusi (cronologico capitaneria di porto), dalle conversazioni telefoniche rese pubbliche; e il segreto istruttorio!? il riserbo delle indagini!? e la prudenza di chi dovrebbe svolgere anche accertamenti a favore dell’indagato (art. 358 c.p.p.) !? di quale cultura della giurisdizione stiamo parlando? Anche l’Ordinanza del GIP di Grosseto solleva forti perplessità nei confronti delle argomentazioni e richieste della Procura arrivando a non convalidare il fermo del C.te Schettino (testualmente: “non ritiene il giudicante che sussista …… il concreto pericolo di fuga”. La Procura ha chiesto la convalida del fermo sostenendo il fondato pericolo di fuga sulla base: 1) dell’avere il C.te Schettino abbandonato la nave; 2) delle conoscenze e dei rapporti umani accumulati nel tempo anche in località estere in ragione dell’attività di navigante del C.te Schettino; 3) della dichiarazione dello Schettino rilasciata ai carabinieri di Orbetello circa l’intenzione di cambiare vita e di non volere più andare per mare. Sulla argomentazione punto 2) scrive (saggiamente) il GIP: “è evidente che questa circostanza sia del tutto ipotetica e comunque sfornita di qualsiasi appoggio anche a livello indiziario”. Sulla argomentazione punto 3) il GIP: “le dichiarazioni ….. sono chiaramente dovute allo sconforto per il disastro provocato e non rivestono alcun rilievo nel senso dell’intenzione di darsi alla fuga”. Anche in relazione a quanto sostenuto dalla Procura in ordine alla intenzione del C.te Schettino di inquinare le prove asportando il Voyage Date Recorder (VDR) della nave, osserva il GIP che ciò “è smentito agli atti”. The European Court Sentences Italy On The Civil Responsibilities Of Magistrates

Another conviction for Italy in terms of their justice system. It was brought to the attention of the European Court that the civil responsibility of Italian Magistrates was limited to conduct which constitutes intentional fault and serious misconduct. The court declared that (Third Section) in the Case C-379/10 (Commission – Italy, Luxemburg, 24 November 2011): “by excluding any liability on the part of the Italian State for the damage caused to individuals by an infringement of European Union Law attributable to a national court adjudicating at last instance where such an infringement results from interpretation of provisions of law or assessment of facts or evidence carried out by that court and limiting such liability to cases of intentional fault and serious misconduct, pursuant to Article 2 (1) and (2) of Law No.117 of 13 April 1988, the Italian Republic has failed to fulfill its obligations in connection with the general principle of the liability of Member States, laid down by the Court in its case-law, for the breach of European Union law by one of its courts adjudicating at last instance, which is a principle established by the Court of Justice of the European Union. Order the Italian Republic to pay the costs”.
A sentence clear in its scope, meaning and value which needs to be implemented within the Italian justice system immediately in order to reaffirm the principle that all citizens are equal before the law. Magistrates may not assume irresponsibility endlessly using the excuse of discretion and interpretation of the law: these interpretive activities – as the Court supported- one may not attribute to a substantive, procedural, community norm an erroneous scope (Case C-244/01, Kobler vs Austria) the interpretation or application of a national norm may not infringe on existing Community Law.  avv.annino@libero.it

Corte di Giustizia dell’Unione Europea: condanna all’Italia sulla responsabilità civile dei magistrati.
Ulteriore condanna per l’Italia in tema di giustizia. All’attenzione della Corte Europea la responsabilità civile dei magistrati, limitata in Italia ai comportamenti riconducibili al dolo ed alla colpa grave. Statuisce la Corte (Terza Sezione) nella sentenza causa C-379/10 (Commissione – Italia, Lussemburgo, 24 novembre 2011): “ la Repubblica italiana, escludendo qualsiasi responsabilità dello Stato italiano per i danni arrecati ai singoli a seguito di una violazione del diritto dell’Unione imputabile a un organo giurisdizionale nazionale di ultimo grado, qualora tale violazione risulti da interpretazione di norme di diritto o da valutazione di fatti e prove effettuate dall’organo giurisdizionale medesimo, e limitando tale responsabilità ai soli casi di dolo o colpa grave, ai sensi dell’art. 2, commi 1 e 2, della legge 13 aprile 1988, n. 117, sul risarcimento dei danni cagionati nell’esercizio delle funzioni giudiziarie e sulla responsabilità civile dei magistrati, è venuta meno agli obblighi ad essa incombenti in forza del principio generale di responsabilità degli Stati membri per violazione del diritto dell’Unione da parte di uno dei propri organi giurisdizionali di ultimo grado. La Repubblica italiana è condannata alle spese”. Sentenza dirompente e chiarissima nella sua portata ed il cui significato e valore bisognerà importare da subito nel sistema giudiziario italiano riaffermando il principio che tutti i cittadini sono eguali davanti alla legge e che non è possibile ipotizzare un’area di irresponsabilità dei magistrati utilizzando senza limiti la scusa della discrezionalità e della interpretazione del diritto; attività interpretativa che – sostiene la Corte – non può attribuire ad una norma di diritto sostanziale o procedurale comunitario una portata manifestamente erronea (v. sent. Corte 30.09.2003, causa C-224/01, Kӧbler) o interpretare e applicare una norma nazionale in modo da condurre, in pratica, alla violazione del diritto comunitario vigente. avv.annino@libero.it

SOLLECITO AND KNOX CLEARED OF MURDER. LAW’S UNCERTAINTY

Amanda Knox and Raffaele Sollecito have been cleared of killing Meredith Kercher by the Court of Assizes of Appeal of Perugia. Four years ago, twenty-five and twenty-six sentences for killing Mez; today acquittal. One or the other: either error and injustice of the Court of Assizes that took two young’s life or error and injustice of today for clearing two killers. But first of all, slowness of a criminal trial at its last gasp. The principle of not guilty is disregarded owing to malfunction of Italian justice that charges the bill to the investigated person and the defendant and that in this  trial has spent four years for acquitting two innocents. Twenty-five years ago, Enzo Tortora had been cleared after a first ten-years sentence. The adversarial trial has not changed anything because the inquisitorial method withstands all reforms; the discretion becomes often abuse; defensive investigations are tagged as of a side and specious, rejected without any motivations. Trial terms are always disregarded except those for sanctions and process forfeiture. Rules are often distorted and subjugated to a criminal policy of local opinions or other times supported by the Supreme Court.  Finally, Italy is far from the right trial. The trial, as defined by someone, is “the big carousel of pain” considering abuse of the measure of custody in prison and inhuman life in our prisons in which the human right are every day violated. What “distance” between the criminal to be reeducated (ascertained his/her guilty) and State that crams inmate people (also in waiting for conviction). Perhaps Amanda Knox will speak about life in prison when she will come back to Seattle.  Anyway, we do not forget Mez, still without truth. avv.annino@libero.it

The Law, Conventions, Negotiations, Human Rights.all finish and everything ends up being only a possibilty within a system of rules that seems to accredit itself as unambiguous but never quite succeeds. In reality those who possess the power use it to their satisfaction, sometimes covertly and other times bending the rules to justify their own means . It happens just as much on an international level as on a national level. The execution of Saddam Hussein, Bin Ladin and ,lately,Gheddafi demonstrates mans innate malice and the incapacity of international negotiations to stop the loss of a human life. Violent deaths without the right to speak. without trial, without transparency. Somewhere there is always someone afraid of words who finds it more convenient to transgress the rules than let the truth be spoken. As officially gazetted, the increase in Value Added Tax kicks in today, increasing from 20% to 21%. The reduced rates of 4% and 10% remain unchanged as pre-established. We are opposed to the governments decision, due to the negative impact that it will have on the cost of living, which as per usual impacts the most on families and those in the lower income groups, as well as the impact on the internal economy and the reduction of consumerism.

Alternatively we would have preferred the choice we continue to support – the abolition of contributions to 8xthousand and 5xthousand which have been integrated into income tax returns and of which for the greater part the proceeds go to the catholic church who have to date not accounted for how these contributions have been utilized.As officially gazetted, the increase in Value Added Tax kicks in today, increasing from 20% to 21%.
